WHAT COOKIES AND TRACKING TOOLS ARE IN GENERAL; GUIDELINES ON MANAGEMENT AND DEACTIVATION

According to the guidelines on cookies and other tracking tools – Italian Data Protection Authority, June 10, 2021, cookies are small text strings, usually composed of letters and/or numbers, that websites (so-called publishers or first parties) visited by the user or other websites or web servers (third parties) place and store, directly in the case of the first parties, indirectly in the case of the second, within a terminal device available to the user.

The reference terminals include, for example, a computer, tablet, smartphone, or any other device capable of storing information.

The software for browsing the Internet and the operation of these devices, such as browsers, can store cookies and then retransmit them to the sites that generated them on a subsequent visit by the same user, thus maintaining a memory of their previous interaction with one or more websites.

The information encoded in cookies may include personal data, such as an IP address, a username, a unique identifier, or an e-mail address, but may also contain non-personal data, such as language settings or information on the type of device used to browse the site.

Cookies can perform important functions, such as session tracking, storing information about specific configurations regarding users accessing the server, facilitating the use of online content, etc. For example, they can be used to track items in an online shopping cart or information used to complete an online form.

On the one hand, cookies allow web pages to load faster and route information over a network – thus in line with obligations strictly related to the operation of websites. However, cookies can also be used to deliver behavioral advertising and measure the effectiveness of an advertisement, or to tailor the type and manner of services provided to the behaviors of the user being observed.

It should be noted that the purposes usually fulfilled by a cookie can also be achieved through other tracking tools and similar technologies, which enable devices to be identified in such a way as to analyze visits to the Website.

CLASSIFICATION OF COOKIES AND OTHER TRACKING TOOLS

COOKIES ARE CLASSIFIED BASED ON:

  • Duration: session cookies or persistent cookies;

  • Source: first-party cookies or third-party cookies;

  • Purpose: technical cookies; cookies for performance analysis and cookies for behavioral advertising (profiling).

DURATION: Cookies that expire at the end of a browser session (normally when the browser is closed or when the session expires) are defined as session cookies and are useful, for example, to keep the browsing session active. Cookies that, instead, are stored for a more extended period (between one session and another) are called persistent cookies and are helpful, for example, to remember your preferences or to propose targeted advertising.

The definition of first-party or third-party refers to the website or domain that installs the cookie. First-party cookies are installed directly by the Website, while third-party cookies are installed by a different domain, for example, when the Website incorporates elements from other services, such as advertising platforms.

PURPOSE:

  • TECHNICAL COOKIES: Used solely to “carry out the transmission of a communication over an electronic communications network, or to the extent strictly necessary for the provider of an information society service explicitly requested by the contractor or user to provide that service” (Article 122, paragraph 1 GDPR). The legal basis for processing technical cookies is the legitimate interest of the website owner, consisting of the interest in operating the website and, where necessary, performing statistics.

  • PROFILING COOKIES: Used to associate specific actions or recurring behavioral patterns in the use of functionalities offered (patterns) with identifiable or identifiable subjects to group different profiles into homogeneous clusters of varying sizes. This allows the owner, among other things, to tailor the service increasingly to the user’s needs beyond what is strictly necessary for service provision and to send targeted advertising messages aligned with the user’s preferences while browsing the internet. Such cookies can only be used with the user’s consent, which also constitutes the legal basis for processing. The user cannot be forced, without an alternative, to consent to receiving cookies or other tracking tools; otherwise, access to the site would be impossible.   • ANALYTICS COOKIES: Perform analysis and statistics on site usage and visitor flow. Such cookies fall into the category of technical cookies if they inhibit the possibility of direct identification of the data subject (so-called single out), meaning that the use of analytics cookies that, due to their characteristics, may be direct and unique identifiers is prevented.

Analytics cookies also fall into the category of technical cookies if it is deemed lawful when the statistical analysis is carried out independently by the first party (i.e., directly by the website owner), using statistics related to multiple domains, websites, or apps attributable to the same owner, without such analyses exceeding a mere statistical count and turning into decision-making processing of a commercial nature.

This means that third parties (who may, for example, provide web analysis services) must not combine the data (even thus minimized) with other processing (such as customer files or visit statistics to other sites, for example) nor transmit them to further third parties, as this would lead to an unacceptable increase in the risks of identifying the user. This is unless the statistics they produce with minimized data concern multiple domains, websites, or apps attributable to the same owner or business group.

The new measures align with the provisions of Article 25, paragraph 1, of the Regulation on privacy by design, aimed at “effectively implementing data protection principles”: an objective achievable through data minimization measures that significantly reduce the identifying power of analytics cookies when used by “third parties.”

The legal basis for processing is that of technical cookies where they fall into this category, or consent where they do not.
